Lawyer sinasabing Sinungaling ang Comelec dahil totoo ang sinasabi ni Senator Sotto na may dayaan na nangyari noong nakaraang Election!

Recently Senator Tito Sotto, in his privilege speech before the senate, spoke about the possibility of an “electoral sabotage” during the May 9, 2016 elections claiming that he has sources, data, and information, to support such allegations.

Consequently, the Commission on Elections (Comelec), through its Spokesperson James Jimenez responded to Sotto’s allegation. He claimed that even on the day of the election, the Comelec has still supervised final testing and sealing procedures synchronous to Sotto’s accusation that on certain provinces, electoral data transmission began May 8, 2016 until early morning of May 9.

Such defense presented by Spokesperson Jimenez, according to Atty. Glenn Chong, a distinguished lawyer and anti-electoral fraud activist, is a “big lie”. His refutal is anchored on certain provisions enclosed in Comelec Resolution No. 10057.

“Ayon sa Comelec Resolution 10057, Article III, Section 6, ang final testing and sealing (FTS) ng mga voting machines ay dapat isasagawa sa May 2 hanggang May 6, 2016 lamang. Wala ng FTS pagkatapos nito. At ayon din sa Article VII, Section 33 (ff), malinaw ang instructions sa mga Boards of Election Inspectors – kapag nagtanong ang voting machines kung ipadala o i-transmit ba nito ang resulta ng FTS – pindutin ang HINDI! At may note pa sa nasabing probisyon – NOTE: For purposes of FTS, no transmission of election results will be performed.”

Such provision, if taken into consideration is enough prrof to claim that the Comelec itself had violated its own electoral rules and procedures.

“Tama si Sen. Sotto, hindi transmission testing ang pumasok simula noong May 8, 6:46 ng umaga. Pekeng resulta ang mga iyon na gustong ipasok ng mga mandaraya bago magsimula ang halalan. Sinungaling lang talaga itong si James Jimenez.” Atty. Chong additionally claimed.

In his privilege speech, Sotto also acknowledged the nuisance made by a foreign server during the actual transmission of electoral data which could be accounted as a “serious technical interference” in the COmelec’s transmission system.

Spokesperson Jimenez with fervency, had again refuted this allegation and claimed that the Comelec indeed had allowed the use of a cloud service like “amazonaws.com” to ensure the security of data which is then reflected in the official website.

“Ito ay isa pang malaking kasinungalingan.” Atty. Chong asserted followed by an exposition that on the Comelec’s website actual election results have not been posted as it is “no longer available”.

Such negligence on the part of the Comelec, according to Atty. Chong is a violation on the part of the Comelec.

“Ayon sa Republic Act No. 9369, Section 33, ang digital files ng resulta ng halalan ay dapat nakapost sa kanilang website sa loob ng 3 taon mula ng ito ay naipost. Wala silang ipinakita o ipinost sa kanilang website na resulta dahil takot na makita o madiskubre ng mga netizens ang kanilang mga anomalya at dayaan. Takot ma-audit ang resulta dahil nga may madyik.” Atty. Chong claimed warily.

Taking into consideration Atty. Chong’s allegation that Comelec Spokesperson James Jiminez is a “liar” plus the current status of former poll commissioner Andres Bautista and Smartmatic’s Project Manager Marlon Garcia who both have arrest warrants, it is indeed unlikely for the Filipino citizens to believe that the previous election supervised by these abovementioned individuals is credible and fraud-free. Hence, a probe as what Senator Sotto requested should accordingly unfold.
